Terms of Service

Last updated: February 2025

By using MusicPulse ("Service"), you agree to these Terms of Service. MusicPulse is operated from France. The Service is hosted using infrastructure that may be located in the European Union (e.g. Netherlands).

1. Acceptance

By creating an account or using the Service, you accept these terms. If you do not agree, do not use the Service.

2. Description of the Service

MusicPulse provides an AI-powered platform for independent artists: mix analysis, playlist matching, pitch generation, performance tracking, and related features. We reserve the right to modify or discontinue features with reasonable notice when possible.

3. Account and eligibility

You must provide accurate information and keep your account secure. You are responsible for all activity under your account. The Service is intended for users who are at least 16 years old (or the age of majority in your jurisdiction).

4. Fees and payment

Paid plans are billed according to the pricing displayed at the time of purchase. Payments are processed by Stripe. Refunds are handled in accordance with our refund policy and applicable law. We may change prices with advance notice; continued use after the change constitutes acceptance.

5. Acceptable use

You agree not to use the Service for any illegal purpose, to infringe others' rights, or to abuse the platform (e.g. spam, reverse engineering, circumventing usage limits). We may suspend or terminate accounts that violate these terms.

6. Intellectual property

You retain ownership of the content you upload (e.g. music, texts). You grant us the rights necessary to operate the Service (e.g. to process and analyze your tracks). MusicPulse's brand, software and materials remain our property.

7. Limitation of liability

The Service is provided "as is". To the fullest extent permitted by law, we exclude liability for indirect, consequential or punitive damages, and our total liability is limited to the amount you paid us in the twelve months preceding the claim.

8. Termination

You may close your account at any time. We may suspend or terminate access for breach of these terms or for operational reasons, with notice where reasonable.

9. Governing law and disputes

These terms are governed by the laws of France. Any dispute shall be subject to the exclusive jurisdiction of the courts of France, unless mandatory consumer law in your country provides otherwise.

10. Contact

For questions about these terms, please use our contact form.

11. Meta Ads Service

Campaign Management

MusicPulse manages advertising campaigns on its own Meta ad account on behalf of the artist. By connecting your Facebook/Instagram Page via OAuth, you authorize MusicPulse to publish advertisements in your name. MusicPulse acts as a technical and advertising intermediary — not as a co-owner of your Page. You remain the owner of your Page and may revoke access at any time. MusicPulse does not guarantee specific results (streams, followers, etc.).

Commission & Pricing

MusicPulse charges a commission of 10% on each campaign plus 30 MusicPulse credits. The remaining 90% is allocated entirely to the Meta advertising budget. The minimum budget per campaign is 30 EUR.

Refund Policy

If Meta rejects the advertisement (non-compliance with Meta Ads policies), MusicPulse will fully refund the prepaid amount (including commission) and re-credit the 30 MusicPulse credits. If the campaign is launched then suspended by Meta mid-flight, MusicPulse refunds the unspent budget (excluding commission on the amount already spent). If the artist cancels before submission to Meta, a full refund is issued minus Stripe processing fees. No refund is provided if the campaign ran normally, even if the artist is not satisfied with the results. Refunds are processed within 7 business days to the original payment method.

Content Responsibility

The artist is solely responsible for the creative content (image/video) of their advertisement. MusicPulse does not verify compliance with Meta policies before submission. If an ad is rejected, the artist may modify the creative and launch a new campaign.

Data & Privacy

MusicPulse accesses Page data only for the purpose of managing advertising campaigns. Campaign statistics are visible only to the relevant artist in their MusicPulse dashboard. MusicPulse does not sell or share artists' Page data with third parties.
