Terms of Service

These terms of service and sale (the “Terms”) govern access to and use of the MusicPulse platform available at www.musicpulse.app (the “Service”). By creating an account or using the Service, you accept these Terms without reservation. If you do not agree, you must not use the Service.

1. Publisher and legal notice

The Service is published by Pierre-Albert Benlolo, sole proprietor (entrepreneur individuel) under French law, registered under SIREN number 522 424 209 (head-office SIRET: 522 424 209 00024), with registered office at 27 B rue Singer, 75016 Paris, France. Intra-community VAT number: FR86522424209. Publication director: Pierre-Albert Benlolo. Contact: via the form at www.musicpulse.app/contact.

Application hosting: Railway Corp., 548 Market St, San Francisco, CA 94104, USA (railway.com). Data hosting: Supabase, Inc., with data stored in the European Union (Ireland region). Payments are processed by Stripe (see section 7).

2. Purpose and acceptance

These Terms define the conditions under which MusicPulse provides the Service and the parties' mutual obligations. Together with the Privacy Policy and the Cookie Policy, they form the entire agreement between you and the publisher.

You accept the Terms when creating an account, via a dedicated checkbox, and each time you use the Service. The applicable version is the one in force at the time of use; the current version is permanently available on this page.

3. Description of the services

MusicPulse is a platform for independent music artists and producers offering in particular: technical analysis of audio files (loudness, spectrum, dynamics, streaming readiness); version comparison of a track; automated mastering; matching against a database of independent playlists and curators, and generation of submission messages (“pitches”); cover art and video generation; music generation; career tools (release passport, provenance certificate, release plan, content calendar, smart links and fan contact collection, profitability tracking, file vault); streaming performance tracking; and an optional advertising campaign service (section 16).

Analyses, scores, matches and recommendations are strictly indicative: they are decision-support tools and in no way guarantee any specific outcome (streams, playlist placements, curator acceptance, revenue). The publisher is bound by an obligation of means.

4. User account

Account creation is reserved for natural persons aged fifteen (15) or over. Paid offers may only be purchased by adults or by minors represented by a holder of parental authority. The Service is intended for professional or personal use in connection with a musical activity; an account is personal and may not be shared.

You agree to provide accurate, up-to-date information and to keep your credentials confidential. Any activity from your account is deemed yours. Notify the publisher without delay of any unauthorised use of your account.

Thirty (30) credits are offered upon account creation; they are unlocked after email verification (accounts created with Google are verified automatically).

5. Credits

The Service works with credits, internal units of account used for paid features. As an indication at the date hereof: track analysis 10 credits; comparison 10; new version of a track 5; mastering 5; cover art 10; video clip 20; music generation 5; pitch 2; sync one-pager 5; release plan 5; content calendar 5. The current price list is displayed in the Service before each paid action and on the Pricing page.

Credits have no monetary value and are non-transferable, non-exchangeable and non-refundable in cash. Unused credits remain attached to the account for as long as it is active; they are permanently lost if the account is deleted.

If a generation fails for technical reasons attributable to the Service, the debited credits are automatically refunded to your balance.

6. Subscriptions, packs and prices

MusicPulse offers: (i) monthly auto-renewing subscriptions — at the date hereof: Solo (USD 9.99 / 40 credits per month), Starter (USD 20 / 100 credits), Pro (USD 50 / 300 credits), Studio (USD 100 / 800 credits); (ii) one-time purchases without subscription — a 50-credit pack (USD 15) and the “Release Pass” (USD 19). Subscription credits are added to the account balance at each billing period.

Prices are stated in US dollars (USD), inclusive of taxes unless otherwise indicated at checkout. The publisher may change its prices; any increase applicable to a current subscription will be notified at least thirty (30) days in advance and will only take effect from the next billing period, and you remain free to cancel before that date.

7. Payment and billing

Payments are processed by Stripe Payments Europe, Ltd. (Ireland), a PCI-DSS certified payment service provider. The publisher never has access to card numbers. Subscriptions are billed in advance at each monthly due date to the registered payment method.

If a payment fails, access to the credits of the affected period may be suspended until the situation is resolved. Invoices are available through the Stripe billing portal, accessible from the account settings.

8. Right of withdrawal

Under Articles L221-18 et seq. of the French Consumer Code, consumers in principle have fourteen (14) days to withdraw from a distance contract.

For credit and pack purchases (digital content and services performed immediately): by confirming the purchase you expressly request immediate performance and acknowledge that, pursuant to Article L221-28, 1° and 13° of the French Consumer Code, the right of withdrawal can no longer be exercised for credits already consumed. Unused credits from a one-time purchase may be refunded upon request made within fourteen (14) days of purchase.

For subscriptions: you may withdraw within fourteen (14) days of subscribing, by any means (in particular via the contact form). If you requested immediate performance, the refund will be reduced by an amount proportional to the service already provided (credits consumed) as at the date of withdrawal.

9. Term, cancellation and account deletion

Subscriptions are entered into for one month and renew automatically. You may cancel at any time, free of charge and without cause, from the account settings (Stripe billing portal). Cancellation takes effect at the end of the current billing period; credits already granted remain usable while the account is active.

You may delete your account at any time from the settings. Deletion is final: stored content (tracks, analyses, vault files) is erased and remaining credits are lost, without compensation.

The publisher may suspend or terminate an account for breach of these Terms, after formal notice remaining without effect except in urgent or serious cases (fraud, security breach, manifest violation of section 11). Credits obtained fraudulently are not refundable.

10. Statutory warranties

Consumers benefit as of right, for the digital content and services supplied, from the statutory warranty of conformity provided for in Articles L224-25-12 et seq. of the French Consumer Code and from the warranty against hidden defects under Articles 1641 et seq. of the French Civil Code. In the event of lack of conformity, the consumer may obtain the bringing into conformity of the service or, failing that, a price reduction or termination of the contract, under statutory conditions. These warranties apply independently of any commercial warranty.

11. Acceptable use

You undertake in particular not to: upload content for which you do not hold the rights or which infringes third-party rights (infringement, uncleared samples, misuse of another person's voice or image); use the Service for streaming-platform fraud (purchased streams, fake accounts, playlist manipulation) — practices the Service actively fights; disrupt the Service, circumvent its technical limitations or perform unauthorised bulk extraction; resell or sublicense the Service without written consent; use the Service to send unsolicited communications.

Failure to comply may result in suspension or termination of the account under section 9, without prejudice to damages.

12. User content and intellectual property

You retain all rights in the content you submit to the Service (recordings, works, texts, visuals — “User Content”). You grant the publisher a non-exclusive, worldwide, royalty-free licence, for the sole duration of hosting on your account, strictly for the technical operation of the Service: storage, transcoding, analysis (including by the processing providers referred to in section 13), display in your workspace and on pages you choose to make public (shared report, smart link, certificate).

You warrant that you hold all necessary rights in the User Content and indemnify the publisher against any third-party claim in this respect.

The MusicPulse platform (software, databases, interfaces, trademarks, designs) is protected by intellectual property law and remains the exclusive property of the publisher. Any unauthorised reproduction is prohibited.

13. Generated content and automated processing

Some features rely on automated models provided by third-party providers (notably Google, Anthropic, OpenAI, Suno and KIE) to analyse your audio files or produce content (written analyses, pitches, cover art, clips, music tracks, action plans). Files and data transmitted to these providers through their business APIs are not used by them to train their models, in accordance with their terms applicable to API services.

Generated content is provided for your use in connection with your musical activity. You are solely responsible for reviewing it before public use and for compliance with the rules of third-party platforms on which you distribute it, including any obligations to declare generated content. The Service provides provenance declaration tools for this purpose.

14. Third-party services and data

The Service displays public data from third-party platforms (notably Spotify) and links to third-party services (distributors, platforms). MusicPulse is not affiliated with any of these platforms; their trademarks belong to their respective owners. The availability and accuracy of third-party data are not guaranteed, and contractual relationships you enter into with third parties (curators, distributors) are your sole responsibility.

15. Liability

The publisher uses reasonable means to provide continuous, secure access to the Service, without guaranteeing uninterrupted availability. The publisher shall not be liable in cases of force majeure, acts of third parties, failure of third-party providers or platforms, or non-compliant use of the Service.

To the extent permitted by law and except in cases of gross negligence or wilful misconduct, the publisher's total liability, all causes combined, is limited to the amounts actually paid by the user for the Service during the twelve (12) months preceding the triggering event. Nothing in these Terms limits liability for personal injury or where the law prohibits it, nor deprives consumers of their mandatory rights.

16. Meta Ads campaign service

MusicPulse offers an optional service for creating and managing advertising campaigns on Meta platforms (Facebook, Instagram). The chosen advertising budget is entrusted to Meta; MusicPulse charges service fees displayed before payment. Campaign performance (reach, clicks, conversions) depends on Meta's platforms and is not guaranteed.

Advertising budget already spent with Meta is non-refundable. If a campaign cannot be launched due to MusicPulse, all sums paid are fully refunded. Ad content is subject to Meta's advertising policies; if rejected by Meta, MusicPulse will assist you in revising it. Campaign data is processed as described in the Privacy Policy.

17. Personal data

The processing of your personal data is described in the Privacy Policy, accessible from the site footer, and in the Cookie Policy. They form an integral part of these Terms.

18. Changes to the Terms

The publisher may amend these Terms at any time, in particular to reflect legal, technical or functional developments. Account holders will be informed of any substantial change at least fifteen (15) days before it takes effect, by email or in-Service notification. Continued use after that date constitutes acceptance; otherwise you may cancel as described in section 9.

19. Governing law — mediation — disputes

These Terms are governed by French law, without prejudice to the mandatory consumer-protection provisions of the EU country in which the user habitually resides.

In accordance with Articles L611-1 et seq. of the French Consumer Code, any consumer is entitled to free recourse to a consumer mediator with a view to the amicable resolution of a dispute. Before any referral, a written complaint must first be sent to the publisher via the contact form. The up-to-date details of the competent mediator are provided on request and on this page. The European Commission also provides an online dispute resolution platform: https://ec.europa.eu/consumers/odr.

Failing amicable resolution, the French courts shall have jurisdiction under ordinary rules; consumers may bring proceedings before any court having territorial jurisdiction under the French Code of Civil Procedure or Consumer Code.
